Terms and Conditions

These General Terms and Conditions (T&Cs) apply to all orders placed by consumers and business customers via the website umo.studio. Deviating or supplementary conditions of the customer shall not become part of the contract unless we expressly agree to them in writing.

The presentation of products on the website does not constitute a binding offer, but an invitation to the customer to submit an offer. By submitting an order, the customer makes a binding offer. We will confirm receipt of the order immediately by email. The contract is formed when we accept the order by a separate order confirmation email or by dispatching the goods.

All prices are quoted in Euro (EUR). For consumers, the prices shown include the statutory VAT where applicable. For business customers with an approved B2B account, net prices plus VAT apply.

Shipping costs:

• Germany: €5.00
• Rest of Europe: €9.00
• Rest of the world: €20.00

For deliveries outside the EU, additional import duties, taxes and customs fees may be payable by the customer.

Payment is made via PayPal or in advance by bank transfer. When paying via PayPal, you may use the payment methods offered by PayPal. For bank transfer, our account details are provided in the order confirmation; the goods will be shipped after receipt of payment.

Delivery is made by DHL/Deutsche Post to the address provided by the customer. The delivery time for stocked goods is normally 1 to 4 weeks unless otherwise stated for the product. Custom-made and personalised items usually require 2 to 6 weeks; delivery times for custom work are agreed individually.

Until full payment has been received, the goods remain the property of Niklas Lamp und Ole von Puttkamer GbR.

Consumers generally have a 14-day right of withdrawal. However, pursuant to § 312g German Civil Code (BGB), this right does not apply to contracts for goods that are not prefabricated and whose manufacture is based on an individual choice or determination by the consumer, or which are clearly tailored to the consumer’s personal needs. This applies in particular to personalised or custom-made products. The right of withdrawal does not apply to such products unless the goods are defective; in that case statutory warranty rights remain unaffected.

Cancellation policy for standard goods:

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period is 14 days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods. To exercise your right of cancellation, you must inform us by means of a clear statement. Sending the notice or the goods before the deadline is sufficient to meet the deadline.

Statutory warranty rights apply in accordance with the provisions of the German Civil Code (BGB). Consumers may claim remedy for defects within the first two years from delivery. For used goods, the limitation period is one year. Commercial purchases are subject to § 377 German Commercial Code (HGB).

In addition, we voluntarily grant a 3-year guarantee on handmade pieces; details are set out in the product documentation.

We are fully liable for intent and gross negligence and under the German Product Liability Act. Otherwise, our liability is limited to typical, foreseeable contractual damage, unless a material contractual obligation is breached. The above limitation of liability does not apply in the event of injury to life, body or health.

Our products are intended for adult customers. By placing an order you confirm that you are at least 18 years old.

Personal data is processed only for the purpose of fulfilling the contract and in compliance with data protection law (GDPR, BDSG). You have the right to access, rectification, erasure, restriction of processing and data portability at any time. Please contact contact@umo.studio.

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.

German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for merchants is Hamburg. Should individual provisions be invalid, the remainder of the contract shall remain effective.
